Terms of Service

Welcome. These Terms of Service (the “Terms”) govern your use of the Muddled mobile application and trymuddled.com (collectively, the “Service”), operated by Ghostwood Software LLC (“we”, “us”). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 17 years old to use the Service. The Service is rated 17+ on the App Store because every recipe references alcohol. You are responsible for complying with the laws of your jurisdiction, including those relating to the purchase, possession, and consumption of alcohol.

2. Your account

• You are responsible for the activity that happens on your account.
• Keep your sign-in credentials secret. Notify us promptly at travis@trymuddled.com if you suspect unauthorized access.
• You may delete your account at any time from Settings → Delete Account. See our Privacy Policy for what is removed.
• We may suspend or terminate accounts that violate these Terms, abuse the Service, or harm other users.

3. Your content

You retain ownership of the recipes, notes, photos, and other content you create in the Service (“Your Content”). By submitting Your Content, you grant Ghostwood Software LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and transmit Your Content solely to operate and improve the Service.

If you set a recipe to Public, you additionally grant other users a license to view, save, duplicate, and reference that recipe through the Service. You can revoke this by changing the recipe back to private or workspace visibility.

What you may not post

• Content that infringes someone else’s intellectual-property rights.
• Content that is unlawful, defamatory, harassing, hateful, or sexually explicit.
• Recipes that encourage dangerous or illegal activity, including the consumption of harmful substances or the encouragement of impaired driving.
• Spam, scams, or content used to manipulate the Community feed’s ranking.

We may remove content that violates these rules and disable accounts that repeatedly post such content. Report violations via the (•••) menu on any community recipe or by emailing travis@trymuddled.com. We act on reports within 24 hours.

4. Subscriptions, billing & trials

Muddled is free to use within the limits of the Free plan. Paid features are available through auto-renewing subscriptions purchased via the Apple App Store.

• Auto-renewal — your subscription renews automatically at the end of each billing period unless you cancel at least 24 hours before the end of the period. Your Apple ID is charged at renewal.
• Free trials — if you cancel during the 7-day free trial, you will not be charged. Trials are available only to new subscribers and only once per Apple ID per subscription group.
• Cancelling — manage or cancel subscriptions in the iOS Settings app: Settings → [your name] → Subscriptions → Muddled. Cancelling stops the next renewal; you retain access until the current period ends.
• Refunds — refund requests for App Store purchases are handled by Apple at reportaproblem.apple.com. We cannot process refunds for App Store transactions directly.
• Price changes — if we change subscription prices, you will be notified at least 30 days before the change takes effect. Continued use after the change constitutes acceptance.

5. Apple App Store EULA

If you obtained Muddled through the Apple App Store, your use is also subject to Apple’s Licensed Application End User License Agreement. In the event of a conflict between these Terms and Apple’s EULA, these Terms control to the extent permitted. Apple is not a party to these Terms and is not responsible for the Service.

6. Acceptable use

• Do not reverse-engineer, decompile, or extract source code from the Service.
• Do not scrape, automate, or otherwise access the Service in a way that places undue load on our infrastructure.
• Do not attempt to bypass subscription gating, rate limits, or access controls.
• Do not use the Service to send spam, malware, or unlawful content.

7. Intellectual property

The Service itself — including the Muddled brand, software, design system, and content we create — is the property of Ghostwood Software LLC and is protected by intellectual-property laws. These Terms do not transfer any rights in our intellectual property to you.

8. AI features

The AI import features use Anthropic’s Claude API to extract structured recipe fields from URLs, photos, and pasted text. Output is generated by a machine-learning model and may be inaccurate, incomplete, or unexpected. You should review and edit imported recipes before using them. We are not liable for losses arising from inaccurate AI output (e.g., a misread ingredient amount).

9. Disclaimer of warranties

The Service is provided on an “as is” and “as available” basis. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that the recipes you create will produce a desired outcome.

10. Limitation of liability

To the maximum extent permitted by law, Ghostwood Software LLC will not be liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Service. Our aggregate liability to you for all claims under these Terms will not exceed the greater of $50 or the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Ghostwood Software LLC from any claims, damages, or expenses arising from Your Content or your breach of these Terms.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your account for material breach of these Terms or for any reason, with notice where reasonably possible. Provisions that by their nature should survive termination (intellectual-property, indemnification, limitation of liability, governing law) will survive.

13. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

14. Changes to these Terms

We may update these Terms from time to time. The effective date at the top reflects the most recent material revision. Continued use of the Service after an update constitutes acceptance of the new Terms.
